Federal Judge Restores DACA Program Pending A 90-Day Stay

A federal judge in Washington D.C. has ruled that the decision to end the Deferred Action for Childhood Arrivals (DACA) program was unlawful and must be set aside. However, the judge stayed his order for 90 days, and gave the Department of Homeland Security the opportunity to better explain its reasoning for canceling the program, or accept new applicants.

This is great news for those individuals who are eligible for DACA but never applied. We advice people to get informed, gather documents, and even fees but don’t start applying, and don’t trust anyone who says they can file an initial DACA for you until you hear anything else.

People who have renewals due should keep renewing. And remember, there isn’t a 6 month window for renewals any longer so if you are concerned about what may happen to DACA and it isn’t expiring till next year, you can still file for renewal.
